DENVER, CO — State Representative Junie Joseph issued the following statement today regarding the lawsuit challenging Denver Public Schools’ equity-focused school board redistricting process.

The lawsuit challenges Denver Public Schools’ decision to redraw school board district boundaries through a process that considered demographic changes and sought to ensure historically underrepresented communities had a meaningful opportunity to elect candidates of their choice. While the courts will determine the legal merits of the case, Rep. Joseph said the issues raised extend far beyond one school district.

“As someone who sponsored the Colorado Voting Rights Act, I believe representation is one of the cornerstones of our democracy,” Joseph said. “When every community has a meaningful opportunity to participate in the decisions that shape its future, our democracy is stronger.”

For generations, Black and Brown communities have had to fight for equal access to the ballot box, equal educational opportunities, and equal representation in government. The Supreme Court’s decision in Brown v. Board of Education ended legally sanctioned segregation in public schools, but it did not erase the systemic barriers that continued to limit opportunity for many communities. The struggle for equal representation has continued through every generation since.

The Colorado Voting Rights Act was enacted to address one of those barriers: vote dilution. The law recognizes that elections should provide every community with a fair opportunity to elect candidates of their choice and seeks to protect against practices that weaken the political influence of historically underrepresented voters.

Rep. Joseph said she is concerned that lawsuits challenging efforts to expand representation are emerging at the same time that communities across the country continue to debate redistricting, voting rights, and fair representation.

“We are living through a moment when the political influence of Black and Brown communities is being challenged in legislatures, in redistricting debates, and in courtrooms across the country,” Joseph said. “Whether this particular lawsuit succeeds or fails, we should all be asking whether our democracy is moving toward broader participation or away from it.”

School boards make decisions that shape educational opportunities, allocate resources, and set priorities for future generations of students. Rep. Joseph said every family deserves confidence that those decisions are informed by governing bodies that reflect the communities they serve.

“Representation is not about guaranteeing outcomes,” Joseph said. “It is about ensuring every community has a meaningful opportunity to be heard. That principle is at the heart of the Colorado Voting Rights Act, and it is a principle I will continue to defend.”
