Statement from Secretary of State Jena Griswold after Trump Elections Executive Order Enjoined

Denver, CO – Today, the United States District Court for the District of Massachusetts enjoined much of President Trump’s Executive Order on mail ballots, which mandated the creation of a federal citizenship eligibility list and required the United States Postal Service to only deliver mail ballots to specific individuals.

Colorado Secretary of State Jena Griswold has issued the following statement:

Today, a federal court enjoined major provisions of Donald Trump’s unconstitutional and unlawful executive order on mail ballots. Trump will not be able to use the Postal Service to control which voters receive a mail ballot, and cannot use the DOJ to intimidate election officials into following his unlawful order. The Constitution is clear: States run elections, not Trump. This is a major victory for American democracy.

Today’s ruling focused on an Executive Order signed by Trump on March 31, 2026. It was the second Executive Order he had issued directly related to election administration during his second term. The first executive order on elections issued during his second term has been the subject of numerous legal challenges and is also largely enjoined by the Federal Courts.

In Colorado, every active voter is mailed a ballot. Colorado voters prefer to vote their mail ballot, with over 98% of all Colorado voters using a mail ballot in the 2025 coordinated election.
